Father & Son Detained by TSA & FBI For “Not Having a Criminal Record”

Father & Son Detained by TSA & FBI For “Not Having a Criminal Record”

(GCN LIVE)   In a breaking exclusive, GCN News has learned of yet more abuse at the hands of the Transportation Security Administration. A father and son were detained by the TSA at an airport in Little Rock, Arkansas, today (Tuesday, Mach 22.) The reason? None. At least nothing logical to any right-thinking American.

“My son has always used the old family name”, Barr said. His son Brady, who is 18 years old, chooses to go by the last name Barraza, which was their family’s Basque surname, pre-Ellis Island.

Despite having never had any issues in the past with air travel, “today they decided to make an issue”, Barr said. “Even though [my son] had Supreme Court case and other federal cases he doesn’t have to get the permission of a judge to use the old family name.”

“Since I was with him, they [the TSA] also the questioned me as his father. I have a driver’s license that doesn’t have a picture on it for my own personal reasons. It’s the law; it’s allowed in Arkansas.”

“It was funny; because we suddenly found ourselves surrounded by five armed Little Rock police officers that they had called in, who then began to question us,” Barr said. “They ran my license and said ‘it shows that it’s a legitimate license, but you have no [criminal] record, so it’s like you don’t exist.’ So now I’m being tormented because I haven’t gotten any speeding tickets and I haven’t broken any laws.”

Barr told GCN News that he had to deal with the TSA, the Department of Homeland Security, the FBI, and the Little Rock police.

“They’re exerting their authority,” he said. “They had the Federal Manager of the assistant in charge of security and a separate investigator from DHS. We were informed that when we entered the security area that we are giving up our right against search and seizure and that we are willingly subjecting ourselves without due cause.” Barr told the authorities that sounded un-Constitutional, which was greeted by silence.

Barr’s son Brady Barraza (Barr) was then told that Washington D.C. needed to be made “aware” that he travels with a “questionable” name. (Racial and ethnic profiling, anyone?) Barraza also does not have a social security number. “He doesn’t exist in the system,” Barr said.

The Barrs’ ordeal became even stranger when an agent asked them the question “Are you sovereign?” When asked what that meant, Barr was told “There have been threats from sovereign groups against the TSA and/or DHS.” Therefore, the new Stasi-like Borg bureaucracy is “concerned” about people who don’t have the “right” papers or who lack an SSN.

Needless to say, despite having an hour and a half before their flight departure, the father and son were detained long enough to miss the flight. “I don’t know if it was ineptitude or indifference, but they did know about our flight. We missed our flight, but our baggage didn’t. Our baggage is now in the air on the way to California, although we were not allowed to fly.”

Authorities told Barr that his “record is clean, so it’s like I don’t exist.”

In the meantime, while waiting 12 hours for his replacement flight, Barr was told by an investigator from DHS that he had been cleared to fly, but his son hadn’t. The investigator informed him that Brady would not be allowed to fly unless he changed the surname on his ticket from Barraza to Barr. No reason, even an irrational one, was given.

As it stands, father and son Chris Barr and Brady Barraza have been detained for an entire day, forced to forfeit their Constitutional rights, and harassed by three Federal Agencies.

Barr did say that the Little Rock police were the easiest to deal with, and tried their best to expedite the process, but their efforts were blocked by the FBI, who claimed they had to do more investigation surrounding the “sovereign groups threat” that was posed by:

• A father and son traveling together with different versions of the same familial surname;

• The son having no Social Security Number;

• The father possessing a legal state driver’s license without a picture;

• Neither party possessing a criminal record.

In short, this father and son are what most people would consider to be model citizens.

This story needs to go viral. Why should law-abiding American citizens be forced to put up with harassment and abuse? What crimes have Barr and Barraza committed?

And what is their legal redress against unlawful detainment? What is their financial redress against emotional stress, lost time, money, and business?
The American people have the right to mobilize and organize against an out-of-control federal agency. It is time to use our rights or lose them.

******

UPDATE: Brady Barraza called GCN News at 5:26 p.m. CST to let us know that he and his father have finally been released by the TSA, DHS, and FBI, and are boarding their flight to California. That makes this a total of over 18 hours of unlawful detention, abuse, and harassment. Look for a follow-up story on their ordeal soon. - Rachael Woodhouse, GCN News.

Serious doubt cast on FBI's anthrax case against Bruce Ivins

Serious doubt cast on FBI's anthrax case against Bruce Ivins

By Glenn Greenwald

For years, the FBI believed that it had identified the perpetrator of the 2001 anthrax attacks -- former Army researcher Steven Hatfill -- only to be forced to acknowledge that he wasn't involved and then pay him $5.8 million for the damage he suffered from those false accusations.   In late July, 2008, the FBI announced that, this time, it had identified the Real Perpetrator:  Army researcher Bruce Ivins, who had just committed suicide as a result of being subjected to an intense FBI investigation.  Ivins' death meant that the FBI's allegations would never be tested in a court of law.

From the start, it was obvious that the FBI's case against Ivins was barely more persuasive than its case against Hatfill had been.  The allegations were entirely circumstantial; there was no direct evidence tying Ivins to the mailings; and there were huge, glaring holes in both the FBI's evidentiary and scientific claims.  So dubious was the FBI's case that even the nation's most establishment media organs, which instinctively trust federal law enforcement agencies, expressed serious doubts and called for an independent investigation (that included, among many others, the editorial pages of The Washington Post, The New York Times, and The Wall Street Journal).

Mainstream scientific sources were equally skeptical; Nature called for an independent investigation and declared in its editorial headline:  "Case Not Closed," while Dr. Alan Pearson, Director of the Biological and Chemical Weapons Control Program at the Center for Arms Control and Non-Proliferation -- representative of numerous experts in the field -- expressed many scientific doubts and also demanded a full independent investigation.  I devoted much time to documenting just some of the serious flaws in the FBI's evidentiary claims, as well as the use of anonymous FBI leaks to unquestioning reporters to convince the public of their validity (see here, here, here, and here).

FBI Calls for Backdoor to Snoop Web

FBI Calls for Backdoor to Snoop Web

The FBI is once again calling for the internet to be converted into a Stasi-like spy grid. “Web-based e-mail, social-networking and peer-to-peer services are frustrating law enforcement wiretapping efforts, a lawyer for the U.S. Federal Bureau of Investigation told lawmakers Thursday,” reports PCWorld.

The Obama administration will attempt to bribe, coerce, or intimidate web-based services not covered by traditional wiretap laws into helping the government turn the medium into a sprawling high-tech surveillance platform.

Valerie Caproni, general counsel at the FBI, reminded the U.S. House Judiciary Committee that the Communications Assistance for Law Enforcement Act, or CALEA, does not cover the internet. CALEA requires traditional telecom carriers to allow law enforcement agencies real-time access to communications.

Instead of forcing ISPs to adopt CALEA, the government will attempt to convince communication providers to build in so-called back doors allowing law enforcement access to their software. Caproni said she’s optimistic the U.S. government can find “incentives” for companies to “have intercept solutions engineered into their systems.”

“We are not looking for any new authority,” she said. “We are concerned we are losing ground in actually being able to gather the information we are authorized to have.”

Laura Murphy, director of the ACLU Washington Legislative Office, said in a statement that the FBI plan “will actually change the structure of the Internet, providing the government with a master key to our online communications.”

Caproni said the FBI is concerned about the internet being used for criminal activity. “That criminal may be a massive drug dealer, they may be an arms trafficker, they may be a child pornographer or a child molester,” she said. “We need the actual ability to conduct the wiretaps so we can keep the streets safe.”

The FBI has a long history of using its authority to monitor and harass political activists. A report by the Electronic Frontier Foundation reveals that since 9/11, the FBI has been responsible for at least 40,000 violations of the law. It has functioned primarily since its inception in the early 1900s as a political police force tasked with going after political activists of all stripes.

“In many cases, many of those now under surveillance by the FBI are ordinary American citizens doing nothing more than exercising their First Amendment right to free speech by criticizing the government,” writes constitutional attorney John W. Whitehead.

Ms. Caproni has sheepishly admitted that the internet continues to stump the FBI and the government. It has allowed activists to coordinate and announce their protest activities. It also represents the greatest single threat to the ruling elite and the government because it allows unfettered dissemination of alternative news that is not reported by the corporate Mockingbird media.

Caproni told the House committee the FBI would have recommendations for Congress soon. Representative Hank Johnson, a Georgia Democrat, said Congress is ready to oblige. “What are you seeking here today?” he asked. “What is it exactly that you would want Congress to do?”

The FBI wants Congress to turn the internet into the largest and most efficient Stasi snoop grid in history. It wants a legal fig leaf to cover its effort to neutralize the opposition through surveillance and ultimately harassment, intimidation, and in the case of the Black Panthers and American Indian Movement activists in the 1960s and 70s, assassination.
